The firm is led by Kyle D. McLean, an experienced litigator who has represented clients in state and federal courts nationwide. Mr. McLean has served as lead and class counsel in precedent-setting privacy litigation and has played a significant role in the development of the Illinois Genetic Information Privacy Act ("GIPA"). His advocacy has helped shape the emerging legal framework governing GIPA claims.

In 2023, Mr. McLean filed the first lawsuit in the nation alleging violations of Section 25(c)(1) of GIPA arising from an employer's request for genetic information. Since that time, he has served as lead class counsel in multiple significant GIPA class actions, securing more than $17 million on behalf of thousands of Illinois residents. In 2026, he became the first attorney appointed as lead class counsel in multiple GIPA class actions, reflecting his recognized experience in this rapidly evolving area of privacy law.

Representative Matters & Notable Decisions

  • First lawsuit alleging violations of Section 25(c)(1) of the Illinois Genetic Information Privacy Act (GIPA). Filed the nation's first action challenging an employer's request for genetic information during the hiring process, helping establish the legal framework governing GIPA employment claims.

  • Five-Year Statute of Limitations for GIPA Claims. Successfully obtained the first ruling holding that GIPA claims are governed by Illinois' five-year catchall statute of limitations rather than the two-year limitations period applicable to personal injury actions. The ruling has since been adopted by multiple Illinois state and federal courts.

  • Defeated Numerous Motions to Dismiss Novel GIPA Claims. Successfully opposed dispositive motions in numerous state and federal cases involving first-impression questions under GIPA, allowing claims to proceed and contributing to the development of Illinois privacy law.

  • First Court-Approved Class Settlement Under Section 25(c) of GIPA. Served as Lead Class Counsel in Page v. Ford Motor Company, securing final approval of a $17.5 million non-reversionary settlement benefiting more than 10,000 class members.

  • Illinois Biometric Information Privacy Act (BIPA) Settlement. Served as counsel in King v. Lightricks US Inc., obtaining final approval of a $4.485 million settlement for approximately 4,000 class members.

  • National Data Breach Litigation. Served as counsel in Carter v. Vivendi Ticketing US LLC d/b/a See Tickets, resulting in final approval of a $3 million settlement benefiting more than 437,000 consumers affected by a data security incident.

  • Appointment as Lead Class Counsel in Multiple GIPA Class Actions. Appointed by Illinois courts to serve as Lead Class Counsel in multiple class actions involving alleged violations of the Illinois Genetic Information Privacy Act, reflecting recognized experience in this developing area of law.
